Update 3/25/2022

  

Bank of America is unwilling to continue to do business with Avatar Property & Casualty Insurance Company (“Avatar”) in receivership.  As a result, any checks issued by Avatar on their Bank of America account will not be honored and the account will be closed.  The Department has identified all uncashed claim checks and will provide all payment and associated claims information to the Florida Insurance Guaranty Association (“FIGA”).  Once the information is transferred, FIGA will review the original claim and pay according to their claim handling guidelines.  We will update this message once all information has been transferred to FIGA.


If you received a Bank of America check from Avatar for payment unrelated to an insurance claim, you will need to file a proof of claim with the Receiver. Proof of claim forms will be mailed to known creditors of Avatar and will also be posted on the following website www.avatar-liquidation.com at a later date.

Update 6/23/2022

Claims data has now been transferred to the Florida Insurance Guaranty Association (“FIGA”) and FIGA has begun processing outstanding claims. Inquiries regarding the status of a claim should be directed to FIGA. For more information about FIGA, please visit https://figafacts.com/ 

Approximately 95% of data needed to process return premiums has been transmitted to FIGA and FIGA is currently processing return premium checks. We anticipate the remaining 5% of data will be transferred to FIGA by mid-July.

Yes.  Your agent is best able to advise you as to your insurance options.  To assist your agent and you in this process, we have notified your agent directly of the cancellation of your policy.

Unearned premiums are covered by the Florida Insurance Guaranty Association (“FIGA”), which has been activated to help pay unearned premium refunds for Avatar policyholders.


No.  The Department will not require Proof of Claim forms from policyholders who have a potential return premium claim in the estate of Avatar.  Potential claims include the return premium claims of policyholders who had a policy in force on the date of the liquidation and all other return premium claims who the Department calculates are due return premium. Policyholders do not need to do anything to file a timely claim for return premium or to have their claim accepted by the Department.


A Guaranty Association is a nonprofit corporation statutorily created to provide a mechanism for the payment of policy related loss claims and unearned premium when an insurance company is liquidated.

If you have an open claim against Avatar, or a lawsuit pending against Avatar or an Avatar insured, you should send your request for a copy of your policy, claim file to the Florida Insurance Guaranty Association [FIGA].  FIGA’s contact information is located at: https://figafacts.com

No. Pursuant to FS 631.67, all proceedings in which an insolvent insurer is a party to, shall be stayed for 6 months. All of Avatar's claim files will be transferred to the Florida Insurance Guaranty Association (FIGA). If you are unable to amicably resolve your claim with FIGA, you may re-file for Mediation with FIGA.

Proof of Claim forms will be mailed to all known claimants in the estate.  A Proof of Claim form must be postmarked or submitted electronically by the Claims Filing Deadline of March 14, 2023.


The deadline for filing claims in the Avatar receivership is March 14, 2023.  


Yes, you may file a Proof of Claim form. However, any form postmarked after March 14, 2023 will be processed as late-filed.  


A Claims Bar Date has not been established at this time.   


Yes.  If you have unpaid invoices for services related to specific claim files (IME, copy charges, legal defense fees, damage estimation, appraisers, adjusting etc.) your claim is considered a General Creditor, Class 6 claim.  A guaranty association does not usually cover these. There may be insufficient assets to pay these types of claims; however, you must file a Proof of Claim form to have your claims considered. These types of claims are most often considered Master Claims as they involve more than one invoice.

Yes.  Agent's commission claims and general creditor claims are not covered by the Guaranty Association but may be filed as claims in the receivership estate. There may not be sufficient assets to pay this priority of claims; however, you must file a Proof of Claim form to have your claim considered. 


No. The Guaranty Association has been activated to pay covered outstanding claims for Avatar policies. 


No. The Guaranty Association has access to the company claim files and will review your claim to determine if it is a covered claim on which payments may be due. If you are not certain that your claim is covered by the Guaranty Association and/or you wish to make a claim directly against the Avatar receivership estate, you must submit a Proof of Claim.


The payment of claims in a receivership are paid in priority order as defined by Florida Statutes, Chapter 631. The only assets available for distribution are the assets of Avatar.


The amount of any potential payment is unknown until after the amount of all liabilities has been established and all reasonable efforts to recover and liquidate assets have been exhausted. Please be advised that it may take several years before a distribution of assets, if any, is made in this receivership, due to collection efforts and litigation.
